Je to pochopite\u013en\u00e9, preto\u017ee zamestn\u00e1vate\u013e prisp\u00f4sobuje po\u010det \u013eud\u00ed svojim z\u00e1kazk\u00e1m a zamestnanci menia pr\u00e1cu pod\u013ea vlastn\u00fdch prior\u00edt. O to n\u00e1ro\u010dnej\u0161ie je sledova\u0165 a dodr\u017eiava\u0165 v\u0161etky povinnosti, ktor\u00e9 stavebn\u00edkovi vypl\u00fdvaj\u00fa z legislat\u00edvy.<\/p>\n<p>Medzi povinnosti stavebn\u00edka patr\u00ed vy\u017eadova\u0165 d\u00f4sledn\u00e9 plnenie v\u0161etk\u00fdch povinnost\u00ed od os\u00f4b, ktor\u00e9 s\u00fa s\u00fa\u010das\u0165ou stavby, s cie\u013eom zabezpe\u010di\u0165 ochranu zdravia a bezpe\u010dnos\u0165 pri pr\u00e1ci. To zah\u0155\u0148a skuto\u010dne enormn\u00e9 mno\u017estvo \u00faloh, od potreby p\u00edsomn\u00fdch pracovn\u00fdch doh\u00f4d cez vyzna\u010dovanie staveniska a rie\u0161enie situ\u00e1cii na \u0148om a\u017e po \u0161kolenia a dohliadanie na dodr\u017eiavanie predpisov bezpe\u010dnosti a ochrany zdravia pri pr\u00e1ci (BOZP).<br \/>\n\u201eJednou z mo\u017en\u00fdch ciest, ako aspo\u0148 \u010das\u0165 povinnost\u00ed prenies\u0165 na plecia niekoho in\u00e9ho a z\u00e1rove\u0148 ma\u0165 garanciu pracovnej sily v takom rozsahu a s tak\u00fdmi sk\u00fasenos\u0165ami \u010di tak\u00fdm vzdelan\u00edm, ak\u00e9 stavebn\u00edk potrebuje, je vyu\u017e\u00edvanie slu\u017eieb person\u00e1lnej agent\u00fary, ktor\u00e1 sprostredk\u00fava do\u010dasn\u00e9 pride\u013eovanie zamestnancov, tzv. person\u00e1lny l\u00edzing,\u201c <strong><span style=\"color: #d8ab65;\">hovor\u00ed Roman Ku\u010dera, gener\u00e1lny riadite\u013e person\u00e1lnej agent\u00fary MAXIN\u00b4S Group.<\/span><\/strong><\/p>\n<p><strong>Zodpovednos\u0165 na tretej strane<\/strong><\/p>\n<p>Pri vyu\u017e\u00edvan\u00ed zamestnancov formou do\u010dasn\u00e9ho pride\u013eovania preber\u00e1 v\u0161etky pr\u00e1va a povinnosti zamestn\u00e1vate\u013ea na seba person\u00e1lna agent\u00fara, ktor\u00e1 je skuto\u010dn\u00fdm zamestn\u00e1vate\u013eom dan\u00fdch \u013eud\u00ed. Zodpoved\u00e1 za vstupn\u00e9 \u0161kolenia BOZP, vykon\u00e1va vstupn\u00e9 lek\u00e1rske vy\u0161etrenia, zabezpe\u010duje pracovn\u00e9 oble\u010denie, pracovn\u00fa obuv a osobn\u00e9 pracovn\u00e9 prostriedky pod\u013ea pokynov \u201eklienta \u2013 stavebn\u00edka\u201c.<br \/>\nZodpoved\u00e1 taktie\u017e za celkov\u00fa administrat\u00edvu spojen\u00fa s pracovn\u00fdmi zmluvami, poisten\u00edm, odvodmi, vypl\u00e1can\u00edm mzdy a v\u0161etk\u00fdmi n\u00e1le\u017eitos\u0165ami pod\u013ea legislat\u00edvy platnej v Slovenskej republike.<br \/>\nDruhou vyu\u017e\u00edvanou alternat\u00edvou je zazmluvnenie \u017eivnostn\u00edka, ktor\u00fd napr\u00edklad na z\u00e1klade zmluvy o dielo fakturuje stavebn\u00edkovi vykonan\u00e9 stavebn\u00e9 pr\u00e1ce.<\/p>\n<p><strong>Nedostatok pracovnej sily<\/strong><\/p>\n<p>\u201eStavebn\u00edci sa n\u00e1dejali, \u017ee stabiln\u00fd pr\u00edsun ob\u010danov z Ukrajiny sa po vypuknut\u00ed vojnov\u00e9ho konfliktu e\u0161te viac zv\u00fd\u0161i a takto aspo\u0148 do\u010dasne vyrie\u0161ia probl\u00e9m s nedostatkom pracovnej sily v tomto odvetv\u00ed hospod\u00e1rstva. No nestalo sa tak,\u201c kon\u0161tatuje Roman Ku\u010dera.<br \/>\nV\u00e4\u010d\u0161ina ob\u010danov Ukrajiny \u010di od\u00eddencov sa toti\u017e zamestnala a zamestn\u00e1va preva\u017ene v automobilovom alebo stroj\u00e1rskom priemysle.<br \/>\n\u201eSk\u00fasen\u00e9 person\u00e1lne agent\u00fary, ktor\u00e9 na trhu p\u00f4sobia u\u017e dostato\u010dne dlho a ktor\u00e9 n\u00e1borovali a op\u00e4\u0165 n\u00e1boruj\u00fa na Ukrajine, dok\u00e1\u017eu z\u00edskava\u0165 do svojej datab\u00e1zy aj dnes tak\u00e9 \u017eiadan\u00e9 profesie, ako s\u00fa mur\u00e1r, tes\u00e1r alebo stavebn\u00fd mont\u00e1\u017enik. Tieto pracovn\u00e9 sily s\u00fa kombin\u00e1ciou n\u00e1boru na Ukrajine a rovnako aj na Slovensku, len treba vedie\u0165, kde ich h\u013eada\u0165,\u201c je presved\u010den\u00fd <span style=\"color: #000000;\">Roman Ku\u010dera z MAXIN\u00b4S Group.<\/span><\/p>\n<p><strong>Krut\u00e1 realita<\/strong><\/p>\n<p>Stavebn\u00edci v\u0161ak vedia, \u017ee probl\u00e9m s dostupnou pracovnou silou, ktor\u00e1 bude ma\u0165 dostato\u010dn\u00e9 vzdelanie, prax, vy\u017eadovan\u00fd pr\u00edstup k pr\u00e1ci aj potrebn\u00e9 \u0161kolenia, bude trva\u0165 aj na\u010falej.<br \/>\nPod\u013ea Aliancie sektorov\u00fdch r\u00e1d dnes pracuje v slovenskom stavebn\u00edctve 181 000 \u013eud\u00ed vr\u00e1tane \u017eivnostn\u00edkov. A to je v\u00fdzva pre \u0161koly, aj pre person\u00e1lne agent\u00fary.<\/p>\n<p><strong>Povinnosti zamestn\u00e1vate\u013ea<\/strong><\/p>\n<p>Okrem toho, \u017ee zamestn\u00e1vate\u013e mus\u00ed zamestnancovi zabezpe\u010di\u0165 pr\u00e1cu a pl\u00e1cu, mus\u00ed:<\/p>\n<ul>\n<li>so zamestnancom podp\u00edsa\u0165 pracovn\u00fa zmluvu (zo z\u00e1kona mus\u00ed obsahova\u0165 druh a stru\u010dn\u00fa charakteristiku pr\u00e1ce, na ktor\u00fa sa zamestnanec prij\u00edma, miesto v\u00fdkonu pr\u00e1ce, de\u0148 n\u00e1stupu do pr\u00e1ce, mzdov\u00e9 podmienky, v\u00fdplatn\u00fd term\u00edn, rozsah pracovn\u00e9ho \u010dasu);<\/li>\n<li>zamestnanca zaregistrova\u0165 v Soci\u00e1lnej pois\u0165ovni de\u0148 pred vznikom poistenia, najnesk\u00f4r pred za\u010dat\u00edm v\u00fdkonu pr\u00e1ce;<\/li>\n<li>do 8 pracovn\u00ed dn\u00ed od vzniku pracovnopr\u00e1vneho vz\u0165ahu ozn\u00e1mi\u0165 t\u00fato skuto\u010dnos\u0165 zdravotnej pois\u0165ovni, v ktorej m\u00e1 zamestnanec uzavret\u00e9 poistenie;<\/li>\n<li>ozn\u00e1mi\u0165 pobo\u010dke Soci\u00e1lnej pois\u0165ovne do 8 dn\u00ed preru\u0161enie nemocensk\u00e9ho poistenia, d\u00f4chodkov\u00e9ho poistenia a poistenia v nezamestnanosti zamestnanca;<\/li>\n<li>predklada\u0165 v\u00fdkaz poistn\u00e9ho a pr\u00edspevkov na starobn\u00e9 d\u00f4chodkov\u00e9 sporenie v \u010dlenen\u00ed na jednotliv\u00fdch zamestnancov a na jednotliv\u00e9 druhy soci\u00e1lneho poistenia;<\/li>\n<li>vies\u0165 a predklada\u0165 Soci\u00e1lnej pois\u0165ovni evidenciu o svojich zamestnancoch na \u00fa\u010dely soci\u00e1lneho poistenia (elektronick\u00e9 eviden\u010dn\u00e9 listy d\u00f4chodkov\u00e9ho poistenia);<\/li>\n<li>ohl\u00e1si\u0165 do\u010dasn\u00fa pracovn\u00fa neschopnos\u0165 zamestnanca (ak trv\u00e1 dlh\u0161ie ako 10 dn\u00ed) a pracovn\u00fd \u00faraz, ktor\u00fd si vy\u017eiadal lek\u00e1rske o\u0161etrenie.<\/li>\n<\/ul>\n<p><strong>Povinnosti pri zamestn\u00e1van\u00ed cudzincov<\/strong><\/p>\n<p>Pri zamestn\u00e1van\u00ed cudzincov platia tieto pravidl\u00e1:<\/p>\n<ul>\n<li>Zamestn\u00e1vate\u013e, ktor\u00fd m\u00e1 z\u00e1ujem prija\u0165 do zamestnania \u0161t\u00e1tneho pr\u00edslu\u0161n\u00edka tretej krajiny, je povinn\u00fd p\u00edsomne nahl\u00e1si\u0165 \u00faradu, resp. \u00dastrediu pr\u00e1ce, soci\u00e1lnych vec\u00ed a rodiny (v pr\u00edpade \u017eiadosti o modr\u00fa kartu) vo\u013en\u00e9 pracovn\u00e9 miesta, ich po\u010det a charakteristiku.<\/li>\n<li>Je povinn\u00fd p\u00edsomne informova\u0165 \u00darad pr\u00e1ce, soci\u00e1lnych vec\u00ed a rodiny o n\u00e1stupe do zamestnania a o skon\u010den\u00ed zamestnania ob\u010dana \u010dlensk\u00e9ho \u0161t\u00e1tu Eur\u00f3pskej \u00fanie, jeho rodinn\u00fdch pr\u00edslu\u0161n\u00edkov a \u0161t\u00e1tneho pr\u00edslu\u0161n\u00edka tretej krajiny do siedmich pracovn\u00fdch dn\u00ed odo d\u0148a n\u00e1stupu do zamestnania a do siedmich pracovn\u00fdch dn\u00ed odo d\u0148a skon\u010denia zamestnania.<\/li>\n<li>Ak ide o \u0161t\u00e1tneho pr\u00edslu\u0161n\u00edka tretej krajiny, ktor\u00fd je dr\u017eite\u013eom modrej karty, t\u00fato povinnos\u0165 pln\u00ed zamestn\u00e1vate\u013e vo vz\u0165ahu k \u00dastrediu pr\u00e1ce, soci\u00e1lnych vec\u00ed a rodiny.<br \/>\nZamestn\u00e1vate\u013e m\u00f4\u017ee zamestn\u00e1va\u0165 \u0161t\u00e1tneho pr\u00edslu\u0161n\u00edka tretej krajiny (z krajiny mimo EU a EHP):<\/p>\n<ul>\n<li>ktor\u00fd m\u00e1 udelen\u00fd trval\u00fd pobyt v SR (trval\u00fdm pobytom sa rozumie trval\u00fd pobyt na 5 rokov, trval\u00fd pobyt na neobmedzen\u00fd \u010das alebo dlhodob\u00fd pobyt);<\/li>\n<li>ktor\u00fd je rodinn\u00fdm pr\u00edslu\u0161n\u00edkom ob\u010dana \u010dlensk\u00e9ho \u0161t\u00e1tu Eur\u00f3pskej \u00fanie a m\u00e1 pr\u00e1vo na pobyt na \u00fazem\u00ed Slovenskej republiky;<\/li>\n<li>ktor\u00fd m\u00e1 udelen\u00fd prechodn\u00fd pobyt na \u00fa\u010del zl\u00fa\u010denia rodiny: 1. po uplynut\u00ed 12 mesiacov nepretr\u017eit\u00e9ho pobytu na \u00fazem\u00ed Slovenskej republiky od udelenia prechodn\u00e9ho pobytu na \u00fa\u010del zl\u00fa\u010denia rodiny, 2. ktor\u00fd je rodinn\u00fdm pr\u00edslu\u0161n\u00edkom dr\u017eite\u013ea modrej karty; \\\\ktor\u00fd m\u00e1 udelen\u00fd prechodn\u00fd pobyt \u0161t\u00e1tneho pr\u00edslu\u0161n\u00edka tretej krajiny;<\/li>\n<li>ktor\u00fd m\u00e1 priznan\u00e9 postavenie Slov\u00e1ka \u017eij\u00faceho v zahrani\u010d\u00ed;<\/li>\n<li>ktor\u00fd m\u00e1 udelen\u00fd prechodn\u00fd pobyt na \u00fa\u010del \u0161t\u00fadia a v\u00fdkon jeho pr\u00e1ce nepresiahne u v\u0161etk\u00fdch zamestn\u00e1vate\u013eov 10 hod\u00edn t\u00fd\u017edenne alebo 20 hod\u00edn t\u00fd\u017edenne, ak je \u0161tudentom vysokej \u0161koly, alebo tomu zodpovedaj\u00faci po\u010det dn\u00ed alebo mesiacov za rok; \\\\ktor\u00fd je \u017eiadate\u013eom o udelenie azylu (po 9 mesiacoch od podania \u017eiadosti o udelenie azylu);<\/li>\n<li>ktor\u00e9mu bol udelen\u00fd azyl;<\/li>\n<li>ktor\u00e9mu bola poskytnut\u00e1 doplnkov\u00e1 ochrana;<\/li>\n<li>ktor\u00fd \u00faspe\u0161ne absolvoval \u0161t\u00fadium na strednej \u0161kole alebo \u0161t\u00fadium na vysokej \u0161kole na \u00fazem\u00ed Slovenskej republiky a bude mu udelen\u00fd prechodn\u00fd pobyt na \u00fa\u010del zamestnania;<\/li>\n<li>ktor\u00fd zabezpe\u010duje na z\u00e1klade obchodnej zmluvy dod\u00e1vky tovaru alebo slu\u017eieb a tento tovar dod\u00e1va, alebo v s\u00favislosti s dod\u00e1vkou tovaru uskuto\u010d\u0148uje mont\u00e1\u017e, z\u00e1ru\u010dn\u00e9 a oprav\u00e1rske pr\u00e1ce, pr\u00e1ce t\u00fdkaj\u00face sa nastavenia syst\u00e9mov v\u00fdrobn\u00fdch zariaden\u00ed, alebo v s\u00favislosti s dod\u00e1vkou tovaru alebo slu\u017eieb uskuto\u010d\u0148uje program\u00e1torsk\u00e9 pr\u00e1ce alebo odborn\u00e9 \u0161kolenia, ak trvanie jeho pracovnopr\u00e1vneho vz\u0165ahu alebo vyslania na v\u00fdkon pr\u00e1ce nepresiahne celkovo 90 dn\u00ed v kalend\u00e1rnom roku;<\/li>\n<li>ktor\u00fd m\u00e1 udelen\u00e9 n\u00e1rodn\u00e9 v\u00edzum a na ktor\u00e9ho sa vz\u0165ahuje program pracovnej dovolenky schv\u00e1len\u00fd vl\u00e1dou Slovenskej republiky.<\/li>\n<\/ul>\n<\/li>\n<\/ul>\n<p>\u010eal\u0161ie kateg\u00f3rie zamestnancov s\u00fa upraven\u00e9 v \u00a7 23a) z\u00e1kona \u010d. 5\/2004 Z. z. o slu\u017eb\u00e1ch zamestnanosti.<\/p>\n<p>&nbsp;<\/p>\n<p><strong>ZDROJ:\u00a0Stavebn\u00e9 materi\u00e1ly &#8211;
